The mother of a 14-year old student of the Premiere Academy, Lugbe, Abuja, Keren-Happuch Aondodoo Akpagher, who died two days later after fallen victim of rape, has sued the School alongside others for negligence, claiming N10 billion damages.
The student was alleged to have died as a result of complications resulting from rape, which left a condom inside her private part.
The defendants in the suit which is pending before a High Court of the Federal Capital Territory (FCT), Abuja are Akinsola Akinfemiwa, Dr. Omotayo Akinfemiwa, Chief M.K. Osuma, AAGMR Ltd (represented by Akinsola Akinfemiwa), Premiere Eye Centre Ltd (represented by Akinsola Akinfemiwa), Christopher Akinsowon, Mrs Grace Salami and Nurse Lois Bung and former Managing Director of Skye Bank.
The bereaved mother, Mrs Vivien Vihimga Akpagher, is praying the court for the following reliefs:
“A declaration that the negligence of the Defendants caused the Plaintiff’s daughter’s Keren –Happuch Aondodoo Akpagher death on the 22nd day of June 2021.
“A declaration that the acts of the defendants, who owed the Duty of Care to Plaintiff’s daughter, were negligent and this led to her death as a result of rape, sexual abuse and molestation which happened under their care.
“A declaration that the defendants’ failure to apprehend the perpetrator or allow the due process of the law to be carried out on time in order to fish out the perpetrator who is within their vicinity have intentionally inflicted the plaintiff with emotional distress, mental distress and nervous breakdown.”
