Abia Court Restrains Burial Of Corpse Found In Bush Until Hearing Of Motion On Notice

A Magistrate Court sitting in Obehie in Ukwa West Local Government Area of Abia State, presided over by His Worship, Jachike Egbuchiwe, on Wednesday, granted an interim injunction restraining the burial of a corpse found in the bush pending the hearing of the motion on notice fixed for December 11, 2024.

The burial of the deceased, Zereuwa Wisdom Ogbonna has already been fixed for Saturday, November 23, 2024.

In a suit no. MUK/MISC.5/2024, filed by Barrister Sam Ogbonna, the claimants / applicants, had through an affidavit deposed to by High Chief Lucky Ogbuji, on behalf of the Isi-Obuzor Autonomous Community, Umuelechi-Asa, Ukwa West Local Government Area of Abia State, told the Court that the lifeless body of the son of the defendant, Sunny Ogbonna, was found in a bush with the head almost cut off and as such cannot be buried until the actual cause of death is determined and the gods appeased, according to the custom and tradition of Umuelechi-Obuzor.

The claimant further avers that both himself as the Chairman of Isi-Obuzor Autonomous Community Council of Chiefs and his Co-Applicant, the Paramount Chief of the defendant’s village, they cannot fold their arms and allow the defendant bury his son, whose death was mysterious, and place the entire community in serious calamity, including untimely and massive deaths.

According to paragraph 8 of the affidavit deposed to by the principal claimant, “according to the custom and tradition of Umuelechi-Obuzor in Ukwa West Local Government Area of Abia State, any person whose death is mysterious and the corpse found in the bush, cannot be buried without the community first ascertaining and confirming the cause of death and appease the gods of the land before burial”.

The claimants had alleged that the deceased was a notorious criminal and bunkerer, who was wanted by the Police before his death.
